2005-06 CONSOLIDATED GRANTS PROGRAM GUIDELINES
The 2005-06 Consolidated Grants Program Guidelines were adopted on January 4, 2006. The final draft Guidelines were made available for public comments from December 22 through December 30, 2005. The comments were reviewed and the Guidelines were subsequently revised.
- The State Water Resources Control Board adopted the 2005-06 Consolidated Grants Program Guidelines on January 4, 2006. The Guidelines were amended on February 1 and 15, 2006 to add language for related litigation and coastal, respectively. These amendments are described in further detail below. These Guidelines establish the process that the Water Boards will use to administer the 2005-06 Consolidated Grants Program.
- Revised "Coastal" Language (2/27/06)
At the February 15 meeting, the State Water Board adopted a revision to the “coastal” language (Section III.D, Page 16 of the Guidelines) to include San Francisco Bay. The revised sentence states: “Coastal refers to the areas under the jurisdiction of the California Coastal Commission and the San Francisco Bay Conservation and Development Commission.”
- Related Litigation (2/7/06)
At the January 4, 2006 meeting, the State Water Board agreed to further consider Section VI.F of the Guidelines, "Related Litigation". This topic was considered at the February 1, 2006 meeting and the State Water Board adopted the language shown below. Additionally, the State Water Board considers the following language sufficient to identify the scope of litigation waiver language in grant agreements made pursuant to other grant programs administered by the Division of Financial Assistance.
- Related Litigation Language for Section VI.F of the Guidelines
"Grant agreements funded by the State Water Board will specify the following: Under no circumstances may a Grantee use funds from any disbursement under this Grant Agreement to pay costs associated with any litigation the Grantee pursues against the State Water Resources Control Board or any Regional Water Quality Control Board. Regardless of the outcome of any such litigation, and notwithstanding any conflicting language in this agreement, the Grantee agrees to complete the Project funded by this agreement or to repay all of the grant funds plus interest."
