Dairy Settlement Agreements

  • Settlement Agreement and Stipulation for Entry of Administrative Civil Liability Order to resolve outstanding penalties for failure to file reports required by Waste Discharge Requirements General Order for Existing Milk Cow Dairies, Order No. R5-2007-0035. This agreement is posted for 30 day public review prior to approval.   • Kinder Morgan Energy Partners, L.P., (SFPP) Chico Terminal
    Kinder Morgan Energy Partners L.P. (SFPP, Discharger) owns and operates a 40-acre petroleum terminal at 2570 Hegan Lane, Chico, and is responsible for petroleum pollution. In 1997, the Executive Officer issued Cleanup and Abatement Order 97-711 (Order) to the Discharger, and in 2002 revised the Order. Due to the Discharger's actions, effective site cleanup and a contingency plan for nearby domestic wells in the Skyway Homes Subdivision, the California Regional Water Quality Control Board, Central Valley Region (Central Valley Water Board) intends to rescind the Order, and instead issue a Monitoring and Reporting Program.   • Red Barn, 656/980 State Highway 299 Bieber
    Red Barn, Discharger, is responsible for gasoline pollutants in groundwater from an underground storage tank system at 656/980 State Highway 299, Bieber, Lassen County. As an interim cleanup action, the Discharger proposes to extract polluted groundwater, treat effluent above-grade with a carbon filtration system, and route treated effluent into an on-site infiltration gallery under General Order R5-2003-0044.   • City of Alturas, Wastewater Treatment Plant
    On 9 September 2011, the Executive officer issued R5-2011-0591, an acl complaint for the mandatory minimum penalty (mmp) in the amount of $156,000 for the violations that occurred between July 2008 and March 2010 from the WWTP . On 3 October 2011 the Central Valley Water Board received a signed waiver of public hearing within 90 days and a request from the City to apply the civil liability towards a compliance project. On 10 November 2011 a draft administrative civil liability Order R5-2011-0596 was transmitted for public review to the City of Alturas. The draft Order contains the findings that the City meets the condition of a financial hardship, has completed a Compliance Project that corrected the violations that led to the issuance of the complaint, and the City expended funds in excess of the mandatory minimum penalty. The draft Order will be posted for 30 day public review prior to approval. Persons wishing to comment on this matter must submit their comments in writing to the Central Valley Water Board no later than 13 December 2011.   • City of Dunsmuir, Dunsmuir Wastewater Treatment Plant
    On May 8, 2012, the Assistant Executive Officer issued an Administrative Civil Liability Complaint R5-2012-0535 to City of Dunsmuir, Dunsmuir Wastewater Treatment Plant, Siskiyou County in the amount of $27,000 for violations of WDRs R5-2006-0129, which represent the sum of the statutory Mandatory Minimum Penalties for effluent violations between 1 December 2011 to 31 January 2012. This complaint is posted for 30 day public review. Persons wishing to comment on this matter must submit their comments in writing to the Central Valley Regional Water Quality Control Board no later than 27 June 2012.   • City of Redding, Benton Class III Municipal Solid Waste Landfill, Post-Closure Maintenance

  • City of Redding, Clear Creek Wastewater Treatment Plant
    On July 19, 2011 the AEO issued an ACL complaint R5-2011-0587, charging the City of Redding with administrative civil liability in the amount of two hundred thousand dollars ($200,000), for effluent violations from the Clear Creek Wastewater Treatment Plant from December 2009 through April 2011. The complaint addresses both statutory mandatory minimum penalties and discretionary penalties for violations that occurred during a March 2011 by-pass event.   • City of Redding, Stillwater Wastewater Treatment Facility, WDID No. 5A450103004
    On 11 May 2011 the Assistant Executive Officer of the Central Valley Water Board issued an administrative civil liability of $72,000 to the City of Redding for discharge violations from its Stillwater Wastewater Treatment Plant. The penalty was for the discharge of elevated levels of residual chlorine in January 2011 to the Sacramento River.   • Former Chacon's Auto Clinic, 4657 Shasta Dam Boulevard, Shasta Lake City, UST Case#450122
    The Ethyl E. Green Trust and Shirley Chacon, Dischargers, formerly owned and operated an automotive service station at 4657 Shasta Dam Blvd, and are responsible for pollution in soil and groundwater. The City of Shasta Lake (City), current owner, under a mutual release and covenant not to sue with the Central Valley Regional Water Quality Control Board (Central Valley Water Board), has assisted the Dischargers by excavating contaminated soils. Limited pollution remains in soil and groundwater; petroleum constituents and chlorinated solvents. The Central Valley Water Board intends to concur with the Dischargers' request for no further action, and rescind Cleanup and Abatement Order R5-2007-0717 (Order). Interested parties should provide comments by close of business, 7 November 2011. After this date, Central Valley Water Board staff will request destructions of three remaining groundwater monitoring wells under Shasta County permit, and then rescind the Order and require no further action on the underground storage tank case.   • Shasta County Service Area No. 17, Cottonwood Watewater Treatment Plant
    On August 9, 2011 the AEO issued an ACL complaint R5-2011-0580 and proposed Stipulated Settlement Agreement charging Shasta County Service Area #17 Cottonwood Wastewater Treatment Plant with administrative civil liability in the amount of fifty four thousand dollars ($54,000), which represents the sum of the statutory Mandatory Minimum Penalties for effluent violations from June 2005 through July 2010. The Stipulated Settlement agreement contains a compliance project that corrects portions of the treatment plant that caused the violations. Shasta County Service Area #17 operates a publically owned treatment works serving a small community that has a financial hardship. These conditions meet conditions in the California Water and the Enforcement Policy that allows compliance projects to settles mandatory minimum penalties.   • Shasta Gold Corporation, French Gulch (Nevada) Mining Corporation and U.S. Department of the Interior, Bureau of Land Management, Washington Mine
    The Executive Officer will issue the TSO after the close of the comment period, after considering any timely public comments. To be given full consideration, any comments or recommendations you may have concerning the proposed TSO must be submitted in writing to the Central Valley Regional Water Quality Control Board (Central Valley Water Board) office by 5:00 pm on 19 December 2011.   • Shasta Gold Corporation & French Gulch (Nevada) Mining Corporation, Washington Mine
    On 4 November 2011 the Executive Officer issued an administrative civil liability complaint of $26,500 to Shasta Gold Corporation & French Gulch (Nevada) Mining Corporation for discharge violations from its mining operation at Washington Mine. In April 2011 the Discharger exceeded effluent limits and reported five serious violations for total recoverable arsenic, total recoverable copper, and total recoverable lead in discharges to surface waters. The five serious violations are subject to minimum mandatory penalties. The Discharger also committed additional violations of it NPDES permit for the failure to use the correct analytical methods as described in 40 CFR Part 136; for priority pollutants and the failure to submit a required report outlining minimum levels, method detection limits, and analytical methods.     On 15 November 2011 the Assistant Executive Officer of the Central Valley Water Board issued an amended administrative civil liability of $33,000 to Union Pacific Railroad Company for discharge violations from the Dunsmuir Railyard. These minimum mandatory penalties are for effluent violations that happen between July 2010 and July 2011. These minimum mandatory penalties are for effluent violations that happen between July 2010 and April 2011.
