Kinder Morgan Energy Partners L.P. (SFPP, Discharger) owns and operates a 40-acre petroleum terminal at 2570 Hegan Lane, Chico, and is responsible for petroleum pollution. In 1997, the Executive Officer issued Cleanup and Abatement Order 97-711 (Order) to the Discharger, and in 2002 revised the Order. Due to the Discharger's actions, effective site cleanup and a contingency plan for nearby domestic wells in the Skyway Homes Subdivision, the California Regional Water Quality Control Board, Central Valley Region (Central Valley Water Board) intends to rescind the Order, and instead issue a Monitoring and Reporting Program. On 9 September 2011, the Executive officer issued R5-2011-0591, an acl complaint for the mandatory minimum penalty (mmp) in the amount of $156,000 for the violations that occurred between July 2008 and March 2010 from the WWTP . On 3 October 2011 the Central Valley Water Board received a signed waiver of public hearing within 90 days and a request from the City to apply the civil liability towards a compliance project. On 10 November 2011 a draft administrative civil liability Order R5-2011-0596 was transmitted for public review to the City of Alturas. The draft Order contains the findings that the City meets the condition of a financial hardship, has completed a Compliance Project that corrected the violations that led to the issuance of the complaint, and the City expended funds in excess of the mandatory minimum penalty. The draft Order will be posted for 30 day public review prior to approval. The Ethyl E. Green Trust and Shirley Chacon, Dischargers, formerly owned and operated an automotive service station at 4657 Shasta Dam Blvd, and are responsible for pollution in soil and groundwater. The City of Shasta Lake (City), current owner, under a mutual release and covenant not to sue with the Central Valley Regional Water Quality Control Board (Central Valley Water Board), has assisted the Dischargers by excavating contaminated soils. Limited pollution remains in soil and groundwater; petroleum constituents and chlorinated solvents. The Central Valley Water Board intends to concur with the Dischargers' request for no further action, and rescind Cleanup and Abatement Order R5-2007-0717 (Order). Interested parties should provide comments by close of business, 7 November 2011. After this date, Central Valley Water Board staff will request destructions of three remaining groundwater monitoring wells under Shasta County permit, and then rescind the Order and require no further action on the underground storage tank case. On August 9, 2011 the AEO issued an ACL complaint R5-2011-0580 and proposed Stipulated Settlement Agreement charging Shasta County Service Area #17 Cottonwood Wastewater Treatment Plant with administrative civil liability in the amount of fifty four thousand dollars ($54,000), which represents the sum of the statutory Mandatory Minimum Penalties for effluent violations from June 2005 through July 2010. The Stipulated Settlement agreement contains a compliance project that corrects portions of the treatment plant that caused the violations. Shasta County Service Area #17 operates a publically owned treatment works serving a small community that has a financial hardship. These conditions meet conditions in the California Water and the Enforcement Policy that allows compliance projects to settles mandatory minimum penalties. On 4 November 2011 the Executive Officer issued an administrative civil liability complaint of $26,500 to Shasta Gold Corporation & French Gulch (Nevada) Mining Corporation for discharge violations from its mining operation at Washington Mine. In April 2011 the Discharger exceeded effluent limits and reported five serious violations for total recoverable arsenic, total recoverable copper, and total recoverable lead in discharges to surface waters. The five serious violations are subject to minimum mandatory penalties. The Discharger also committed additional violations of it NPDES permit for the failure to use the correct analytical methods as described in 40 CFR Part 136; for priority pollutants and the failure to submit a required report outlining minimum levels, method detection limits, and analytical methods.
