SUBJECT:

CONSIDERATION OF A RESOLUTION AUTHORIZING THE EXECUTIVE DIRECTOR OR HIS DESIGNEE TO NEGOTIATE, APPROVE, AND AMEND IF NECESSARY A REIMBURSABLE CONTRACT WITH THE SACRAMENTO REGIONAL COUNTY SANITATION DISTRICT TO SUPPORT THE CENTRAL VALLEY RWQCB ACTIVITIES IN THE SACRAMENTO RIVER WATERSHED

DISCUSSION:

The Sacramento River Toxic Pollutant Control Program (SRTPCP) was first funded by Congress in federal fiscal year (FFY) 1995. The Central Valley Regional Board (Regional Board) has received funds from the Sacramento Regional County Sanitation District (District) and is responsible for major portions of the program. Earlier this year, the SWRCB passed Resolution No. 98-011. This Resolution authorized an Interagency Agreement with the District for up to $485,000. The Interagency Agreement will provide funding for CVRWQCB staff to carry out watershed management and monitoring activities.

Recently, the District has provided an additional $182,000 for conducting additional toxicity monitoring activities. The District has requested that the Regional Board be responsible for managing the toxicity testing portion of the monitoring program.

This additional funding requires a new resolution authorizing the executive director or his designee to negotiate, approve, and amend if necessary, a reimbursable contract for up to $667,000 with the Sacramento Regional County Sanitation District to support the Central Valley RWQCB activities in the Sacramento River Watershed.

POLICY ISSUE:

Should the SWRCB authorize the Executive Director or his designee to support the Sacramento River Toxic Pollutant Control Program and to negotiate, approve, and/or amend an Interagency Agreement with the Sacramento Regional County Sanitation District?

FISCAL IMPACT:

The Central Valley RWQCB and the Budget Office will work to ensure that there is adequate reimbursement authority. The total amount of the contract with the District is $667,000 over a three-year period.

RWQCB IMPACT:

Yes, the Central Valley RWQCB will be managing the contract and directing the work.

STAFF RECOMMENDATION:

That the SWRCB authorize the Executive Director, or his designee, to support the SRTPCP and to negotiate, execute, and/or amend an Interagency Agreement with the Sacramento Regional County Sanitation District.

AUTHORIZING THE EXECUTIVE DIRECTOR OR HIS DESIGNEE TO NEGOTIATE, APPROVE, AND AMEND IF NECESSARY AN INTERAGENCY AGREEMENT WITH THE SACRAMENTO REGIONAL COUNTY SANITATION DISTRICT TO SUPPORT THE CENTRAL VALLEY RWQCB ACTIVITIES IN THE SACRAMENTO RIVER WATERSHED

WHEREAS:

1. The Sacramento Regional County Sanitation District (District) has indicated that it proposes an Interagency Agreement with the State Water Resources Control Board for up to $667,000 to support the Sacramento River Toxic Pollutant Control Program (SRTPCP).

2. The Regional Board would manage an Interagency Agreement with the District.

THEREFORE BE IT RESOLVED THAT:

The SWRCB authorizes the Executive Director or his designee to negotiate, approve, and/or amend an Interagency Agreement with the Sacramento Regional County Sanitation District and the University of California.
